These Terms of Service ("Terms") govern your use of the Vision mobile application (the "App") operated by Incline Labs, LLC ("Incline Labs," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Incline Labs, LLC.
Vision is a professional store monitoring platform designed for independent gas station and convenience store owners. The App provides:
The monitoring service is performed by trained personnel employed or contracted by Incline Labs. The App serves as the delivery platform for alerts, reports, and data generated through this monitoring service.
To use the App, you must have an account provisioned by Incline Labs. You are responsible for:
You must be at least 18 years of age to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement.
You agree to use the App only for its intended purpose and in compliance with all applicable laws and regulations. You agree not to:
The App, including all content, features, and functionality (including but not limited to design, text, graphics, logos, and software), is owned by Incline Labs, LLC and is protected by United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms. This license does not include the right to modify, distribute, or create derivative works based on the App.
To the maximum extent permitted by applicable law, Incline Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the App.
The monitoring service is provided as a supplementary security measure and does not replace the need for on-site security personnel, law enforcement, or other security systems. Incline Labs does not guarantee that all security events will be detected or that alerts will be delivered without delay.
In no event shall Incline Labs' total liability to you for all claims arising from or related to the use of the App exceed the amount you paid to Incline Labs in the twelve (12) months preceding the claim.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. When we make changes, we will update the effective date at the top of this page and notify you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
